Resolution Together: separating with just one lawyer

What is Resolution Together?

Resolution Together is an innovative approach to divorce and separation developed by Resolution, a national organisation of family law professionals. It enables a single, neutral lawyer to work with and advise both spouses jointly, promoting a collaborative and less adversarial approach to resolving issues related to:

  • finances;
  • property; and
  • child arrangements.

The model was introduced following the implementation of “no-fault” divorce, further supporting amicable resolutions.

The approach differs significantly from the traditional approach to divorce, where each party instructs their own lawyer. This often leads to each lawyer advocating solely for their client’s individual interests, potentially resulting in increased conflict, prolonged negotiations, and higher costs. Conversely, Resolution Together aims to de-escalate potential disputes by having one lawyer provide balanced legal advice to both parties simultaneously, encouraging them to work together towards a mutually agreeable outcome.

Benefits of Resolution Together

The benefits of Resolution Together are numerous:

Cost-effective

First, it can be significantly more cost-effective as couples only pay for one legal professional’s time and expertise rather than incurring separate legal fees.

Faster resolution

Second, it often leads to a faster resolution due to streamlined communication and a shared understanding of the legal process, reducing delays caused by back-and-forth communication between two lawyers.

Less stress

Third, crucially, it promotes a less emotionally stressful process by fostering cooperation and reducing conflict. This is particularly beneficial for families with children, as it helps preserve co-parenting relationships.

Taking control

Finally, it empowers couples to take control of their own separation, making decisions collaboratively. Typically, couples feel more involved in shaping their future rather than having outcomes imposed by a court.

However, it is important to note that Resolution Together will not be suitable for all couples.
