The Commonhold and Leasehold Reform Act 2002 (the Act) creates a right for flat owners to take control of the management of their block. The right applies if they form a majority group and exercise the right to manage (RTM) under the Act.

What is the right to manage?

The right to manage can provide an effective solution to concerns over:

  • high service charges;
  • high insurance costs; or
  • poor management of the building/estate.

However, RTM is not available in every case and there is a statutory process which must be followed correctly.

Right to manage solicitors

Exercising your right to manage is a technical procedure with traps for the unwary. We have considerable experience of RTM, having made successful claims on behalf of many groups of flat owners. We can also advise whether RTM is right for you.

What does the right to manage process cost?

No two RTM claims are the same because buildings/blocks of flats vary considerably. You may acquire the right to manage the building alone, or there may be external grounds to include – or exclude. Also, it’s difficult to predict your landlord’s reaction and their approach to the claim. That can affect the amount of work involved and, therefore, the cost involved.

However, we operate a transparent pricing policy. That means as soon as we know what you want to achieve, we will provide you with full details of the likely costs. We will also provide you with cost projections for any possible complications, for example, an uncooperative landlord.

You should always remember that in addition to your own costs, the Act provides that your landlord is entitled to be paid certain costs. We will guide you through this at an early stage.
