Our Private Client team can help you through the process of administering a deceased’s estate and obtaining a Grant of Probate.
Unlike many firms, we do not charge a percentage of the value of the estate.
Our fees are based on the time spent on the matter by different members of the team. The hourly rate of each member of the team is fixed according to their respective levels of experience. Currently, they range from £195* for a probate executive, chartered legal executive and junior solicitor to £230* for a senior solicitor.
The level of fees will depend on the particular circumstances of the matter. As a guide, our fees generally range from £3,750* to £7,950* where there is a will and there are no disputes between executors or beneficiaries. For estates with only one beneficiary, a small number of assets and no inheritance tax liability, the fee will be at the lower end of the range.
For more complicated estates with more than one beneficiary, a larger number of assets (possibly including several properties and multiple investments), trust arrangements and inheritance tax liability, the fee will be at the higher end of the range, but could be more for very complex estates. What’s not included in our fees?
The following matters will not be included in our fees and a separate quote will be provided where required:
- The cost of obtaining any necessary valuations of assets in the estate;
- Dealing with the sale or transfer of any properties in the estate;
- The fees of overseas advisers in relation to foreign assets.
Are there any other sums payable?
In addition to our fees, there will also be disbursements to pay – these are sums we have to make to third parties as part of the process. They include:
- Probate Registry fee of £155
- Fee for office copies of the grant – £0.50 for each copy
- Bankruptcy search fees – £2.00 per beneficiary
- Statutory notice fees – approximately £200 + VAT
How long will the process take?
In most cases we would hope to have obtained a grant of probate within six months of receipt of full instructions and to have completed the bulk of the administration of the estate within a year. There will be exceptions to this when an estate is complicated but we will report to you regularly. A simple matter will be completed more quickly and we will provide you with bespoke time estimates once we have details of the size and nature of the estate.
