Bariatric Surgery Claims
Also known as weight loss surgery, bariatric procedures are commonly offered to patients who are overweight and have unsuccessfully tried to lose weight by other means.
Weight loss surgery sometimes involves fitting a band around the patient’s stomach, thereby reducing its capacity to hold food. However, if the wrong size band is used or it is fitted incorrectly, a leakage or blockage can occur.
In another method, gastric bypass involves stapling the stomach and shortening the patient’s intestines which risks complications such as leakage into the gastrointestinal system, blood clots and lung and breathing problems.
“It’s difficult to believe it’s all over David. Just knowing that we’re now financially secure is probably the best therapy I’ve had so far. I can’t even begin to imagine what mess I’d be in if I hadn’t found you. Thank you from the whole family.” JF, December 2017
Like many other surgical procedures, it can be risky and sometimes result in complications such as haemorrhage (internal bleeding) and damage to other organs. Usually, these procedures are performed laparoscopically (keyhole surgery). This reduces the risk of post-surgical infection, minimises any scarring and shortens the recovery period. However, sometimes mistakes are made which in some cases have resulted in fatal consequences.
David Gazzard has over 25 years’ experience as a specialist medical negligence solicitor. In that time he has developed a wealth of expertise representing people affected by poorly performed bariatric surgery.
In a recent tragic case, David acted for the next of kin of a gentleman where weight loss surgery resulted in lacerations to a number of his organs including his gall bladder and bowel, which in turn led to leakage, peritonitis and ultimately his death.
David secured admissions of liability and causation and a negotiated settlement was then achieved for his family.
“David Gazzard supported my family and I through a very difficult time. David is not only a first rate solicitor but if my own experience was anything to go by, he has huge empathy for his clients. I would strongly recommend him.” AJ, January 2017
