Why choose our Agricultural Property Lawyers?
Agricultural property is a valuable asset and when you require legal advice, assistance or representation in connection with it, it is crucial that you instruct a specialist Agricultural Property Solicitor.
Our team at BLB Solicitors regularly advise farmers, farming businesses and landowners as well as investors on a wide range of matters from acquisitions to sales and a host of matters in between.
You may wish to apply for a change of use, perhaps to residential or for a renewable energy project. Conversely, you may have been approached by a developer or a telecoms company in this regard. In either case, instructing a specialist solicitor will be crucial in helping you to maximise the full potential and value of your land. At BLB, our team really do understand how the industry works.

Buying and selling agriculture land
Acquisitions of agricultural land can be a challenging process. As experts, we can advise you on the implications of any existing tenancies, licences and rights of way, as well as ascertaining whether all of the necessary rights exist in respect of your intended use.
If the sale is of part of your land only, we will ensure that sufficient rights are preserved for the benefit of the retained land, as well as drafting any new covenants which may be required to bind the land sold.
Commonly, we draft protective overage provisions for any agreed uplift should the land be developed in the future as well as promotion agreements.
For both acquisitions and sales, we will deal with the transfer or retention of any entitlements or subsidies as may be agreed.
We have considerable experience advising on all matters relating to agricultural holdings in their various forms, for example, Farm Business Tenancies, including access, planning and use as well as how the arrangement in place can be brought to an end.
Many owners of agricultural property are also residential landlords. If you are looking for advice regarding a new tenancy or a dispute has arisen with either an existing tenant or with anything to do with your land, we can help.
Rights of way
As a property owner, private rights of way are one of the most common easements you will encounter. These occur when a person or particular group of people are granted the right to cross other land. Common issues we advise on are whether a right of way legally exists, whether a right of way can be extinguished (by way of a deed of release) and interferences with rights of way.
If you are providing livery services, it is imperative that you have in place an agreement to protect you if things go wrong. We can prepare a bespoke livery agreement (a livery contract) which sets out clearly the extent of the livery services together with each party’s responsibilities and liabilities. Crucially, it will also detail what will happen to the horse and any equipment if livery bills are not paid.
