What is a Prenuptial Agreement?
A Prenuptial Agreement is an agreement signed before you get married. A Postnuptial Agreement is signed during the marriage. A Nuptial Agreement will set out what you and your (intended) spouse agree should happen to your finances if, sadly, the marriage breaks down and you become separated.
Nuptial Agreements can be useful when one or both parties would like to retain assets they acquired prior to the marriage, should they get divorced.
Whilst both Prenuptial and Postnuptial Agreements are still not binding under English Law, the courts are increasingly taking them into account during divorce, where certain criteria and safeguards have been met.
