Kernott v Jones : Supreme Court hands down judgment

The long awaited decision of the Supreme Court in the case of Kernott v Jones [2011] UKSC 53 has recently been published. The Court found that the parties had intended their respective shares in their jointly owned property to crystallise when they separated, with Mr Kernott's interest being limited to 10%. Ms Jones had continued to make the mortgage payments and maintain the property without assistance from Mr Kernott following their separation, and she received the benefit of that as well as from the rise in the property value.
